    Want to just take away freedom of speech while your at it? If that happens then I guess I’ll finally open my own office.

    Where everything is, does and will go wrong is in the mention of the word Attorney. Anytime they are involved good things go to hell.

    This alone would be near impossible. My listings are syndicated on so many sites I couldn’t possibly know exactly where. I hired a net researcher a few years ago to see where my listings were showing up and he found one of my listings on over 100 sites. Many of them I had never even heard of before.

    Training for risk management before we post???? I think we are all beaten to death with risk worries just taking the real estate licensing classes and every class afterward. How much more do you need. Sounds like an awful lot of regulations to me. May as well have the federal government take over and regulate the real estate business state by state.

    Count me out.

    The freedom of speech is greatly retarded in this industry as it is. You may not say things that would be considered confidential, you cannot say things that are a violation of fair housing, etc…

    A broker having policies to protect themselves and their clients is a prudent measure that should already be in place for many aspects of practice.

    As far as maintaining the list, this should be a good marketing tool for listing agents anyway. If I use list hub, MLS and Postlets, I can easily obtain where those sites syndicate to and create a quick spreadsheet. The COE and most state’s law require agents to stop marketing home “For Sale” when the home is no longer for sale. Time and again we find homes listed online from agents who aren’t even in the business any longer and when the issue is brought to the Broker, they haven’t a clue that those advertisements are out there.

    We may not like that word “attorney” but to deny this is a litigious business is foolish.

    I do a Social Media Risk Management class about every month. It takes about 20 minutes to go to activerain.com and find countless violations of the law and code of ethics. You may be a great agent online and thus this wouldn’t apply to you. Unfortunately, I seen a great deal of stupidity from agents online.

    If I were your broker and you wished to go open your own office, rather than follow these simple policies, I would shake your hand and wish you the best of luck.

    Matt, I see a few things here:
    1) The Brokers I know are NOT going to monitor the online activities of their agents. Would most even know how?

    2) Asking other techy agents to help you out is not gonna happen either, unless they have no business, and I find that hard to believe a “techy” agent would not.

    3) As you said social media is no different than going to local events, no way do we say who we are and what we do every time we engage people.

    4) Specifically what are you talking about on AR? Most vents are members only that I see and you know I am on that a lot.

    1. I completely agree that this is inspirational and its what I think a Broker SHOULD be doing. I know two brokers very well who purposefully engage their agents on Facebook and learned how to use a reader solely to monitor their agents blogs in RSS. Neither Brokers are wild about doing it, but see the need. The company who has just hired me, has done so to help with just these issues. So, yeah some brokers are taking this more seriously than others.

    2. There are a number of Techie agents who would add other agents to their RSS feeds to ensure that the company image is upheld…or at least they would if they were going to make more money from it.

    3. I agree, which is why I am working with our influential committees to make sure that I don’t have to give a disclosure on Twitter, etc…

    4. I don’t care if it’s members only, I see a lot of questions and war stories where the agents give WAY too much information about their clients. The requirement to hold client information in confidence doesn’t go away when you’re in the members only section of AR. I’ve seen people, in an attempt to get help that should be given by their broker say where their client works, the type of home they are buying, the status of their divorce and issues with the lender. That’s just crazy. What if I were the listing agent and read that, would I not be compelled to tell my sellers what I had learned on the Blog? How about the agent that was removed from AR for racists comments? Does that matter that it was in the member only section?

    I knew that this post would be unpopular with re.net as most are non-conformist. None-the-less the broker needs to take reasonable protections in the case of a lawsuit. I know several Brokers who don’t want this hassle and decide to not affiliate with agents. I can’t say that I blame them, managing is a full time job. Managers need to be vigilant to protect their clients and themselves.

    I hope that you will attend my session at the Virtual REBarCamp — these issues are the exact types of things that we’ll be discussing in “Broker’s View: Using Social Media within Your Brokerage”

    I try to friend and follow ALL my agents who are using Facebook, Twitter, blogs, etc. I think this is just a good policy for any supervising broker.

    In terms of disclosure on Twitter or Facebook, if you’ve been to Ben Martin’s presentations, he’s advocated that disclosures should be no more than one click away. My recommendation for this would be having a link to your blog or website (which presumably has the proper disclosures) within your Twitter or Facebook (or other social media) profile.

    As a broker, this is a subject dear to my heart. I am pretty sure I was the first in our area to address social media in our company policy & procedures manual. You have great suggestions above, my manual is not as inclusive as it needs to be and I am going to re-work it using some of your recommendations. I can only imagine how hard this will be to implement and manage for large companies.

    I will never forget the look on many brokers’ faces at a recent technology luncheon when they were asked what their policy on social media was. I see their agents on FaceBook and shudder on their behalf.

    I want to promote the use of social media as a marketing tool in the proper manner, but as a broker I am utimately the one responsible. Freedom of speech does not apply for real estate licensees, especially when MY broker license and my wallet are the ones at risk.I

    Good Stuff. You’re right, nobody likes to be told what they can and can’t do, but, we all want law and order to protect us, human nature I suppose.

    There are valid points made in here for sure. Lots of them actually.

    However #1 blows me away and is an insult to any excellent blogger. How can you have an intense, gripping blog without strong opinions versus “Agents may write only factual statements….” I don’t get it. What’s the point then? Are agents not supposed to share opinions on market trends or industry trends publicly? I can see that coming as more $$$$ gets stolen from my 5 children in the name of “stimulus” and health care by the erosion of general liberties.

    However in the RE industry the most popular and influential blogs are likely to be those that also offer strong opinions and insights into the marketplace. Do you disagree?

    Are agents supposed to check their personalities at the door and their instincts from being on the front lines of real estate and hide that wealth of information from the public because they cannot document it as a fact. The whole concept of #1 is Orwellian when cogitated upon.

    I’d hardly have any blog posts that could clear #1 alone.

    And let me exit by reiterating this is a great post and has great and practical advice no doubt. But #1 is just bogus.

    Maybe you could clarify???? or expand on it Rathburn?

    My broker and most I know could never and would never monitor posts like you are asking. We have 700+ brokers in ~ 20+ offices across the Front Range. They can barely keep up with internet trends from 5 years ago much less what’s going on now with blogging and social media.

    #6 Doesn’t the IDX agreement allow you to show other broker’s listings on your web site? I would think that should cover asking them for permission wouldn’t it?

    Seems like way too much regulation. I hate regulation—if you can’t tell. I just want to sell homes, do a good job and give excellent customer service.

    I think you’re the guy from NOVA, that I read from time to time? Thanks for the opportunity to clarify my point. I think you can and should give an opinion, but if you’re going to give an opinion, such as “Offering a bonus to the Selling Agent, only if they bring a Full Price Offer is bad” than you should be able to substantiate that with case law, legislation or the Realtor Code of Ethics. If you can’t put your finger on it, than that’s ok; just make sure that people clearly know your opinion from fact.

    My point is that the reader should be able to clearly define opinion from fact. To further illustrate my point – the RE Blogger who wrote that a Builder was going into BK and had before. It’s the “had before” that got him in trouble, because he didn’t show it as a fact. If I’m making a statement of fact, than I should have to support it.

    I’m a homeschooling father and it’s only partially based on my strong faith convictions. However, I do not go on my blog and post that the Public School system is heathenish, because I have no facts to back it up.

    Perhaps I should have worded that policy better to say just what I just said in my comment :)

    Does that make more sense?

    I’m with you. I hate over regulation, but really these policy recommendations are backed by some wrong doing somewhere. It kills me that a group of people (RE.net) who routinely call for the “raising of the bar” always seem to bulk at a rule or policy that actually affects them. All of us do it, however. This post was intended to protect the Broker.

    Yes, you can deliver IDX on your blog, but IDX dictates how that information is delivered and the Listing Broker agreed to have that information released via IDX and within the constraints of IDX. A key element to most IDX is that the listing companies name must be attached to their listings.

    #6 relates to agents who are going out taking photos and videos and re-marketing the listing as if it were their own. I love what FranklyMLS.com has done, where they do give props to the listing company, but agents can go augment the IDX by adding photos, links to videos and comments. However, that’s an augmentation to IDX. We have agents locally who do a whole new marketing profile on the home, including interior shots and the Seller NEVER gave permission for this buyer agent to do so.

    If I want to take IDX and say, here’s the 10 lowest price homes, that would OK as long as you’re linking back to the IDX which the Seller and Lister mutually agreed on.

    Thanks for the clarification and that does make more sense now as being somewhat reasonable. I’m sure I’ve crossed the line regardless. Good thing I’ve started my broker classes for when I get kicked to the door by Big Brother Broker (BBB) at some point. [side note--it's pathetic when disagreements over sense of humor lead to backstabbing by agents within your own brokerage]

    I say you’re not a great blogger if you haven’t been threatened with lawsuits–haha.

    We homeschool our soon to be 5 children as well so I relish my independence–especially here in VA versus other states which are much lower on the liberty scale.

    Back to showing property and doing listing appointments in flip flops….
